1. Agreement
These terms govern your use of the Cloud-IQ website, platform and connectivity services provided by Cloud-IQ Limited, a DigitalSom company ("Cloud-IQ", "we", "us"). By using our services you agree to these terms. Enterprise customers may have a separate signed agreement, which takes precedence where it differs.
2. The services
Cloud-IQ provides global IoT connectivity — including multi-network SIMs, tariffs, device and SIM management tools — and related support. Service availability depends on the coverage of partner mobile networks and may vary by country and network conditions.
3. Quotes and tariffs
Quotes are prepared from the requirements you provide (countries, networks and data allowances) and remain valid for the period stated on the quote. Tariffs may be customised, and SIMs may be moved between tariffs as agreed with us.
4. Accounts
You are responsible for keeping your account credentials secure and for all activity under your account. Tell us promptly if you suspect unauthorised access.
5. Acceptable use
You may not use the services for unlawful purposes, to send spam, to interfere with networks or other customers, or in breach of the policies of the mobile networks that carry your traffic. We may suspend service to protect the platform, other customers or partner networks.
6. Fees and payment
Fees are set out in your quote or agreement and are payable by the due date on the invoice. Late or non-payment may lead to suspension of service after reasonable notice.
7. Intellectual property
The platform, website and all related branding remain the property of Cloud-IQ and its licensors. You receive only the right to use the services for your business while your account is active.
8. Liability
We provide the services with reasonable skill and care, but mobile connectivity depends on third-party networks and no uninterrupted service is guaranteed. To the maximum extent permitted by law, our liability is limited to the fees paid for the affected service in the twelve months before the claim, and we are not liable for indirect or consequential loss.
9. Termination
Either party may end the agreement in line with its notice terms. On termination we deactivate your SIMs and close your account; clauses that by nature survive (such as payment and liability) continue.
10. Governing law
These terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction, unless your signed agreement states otherwise.
